This website operates under the First Amendment of the United States Constitution and contains material of an adult nature. diMENsions will not participate in unconstitutional restrictions on lawful speech imposed by a handful of U.S. states. diMENsions stands by the settled U.S. Supreme Court case, Ashcroft v. ACLU (2004), which struck down federal age verification laws as a content-based restriction on speech subject to strict scrutiny.
In Ashcroft v. ACLU (2004), the Supreme Court emphasized that the government failed to prove that age verification laws were the least restrictive means of protecting minors while still allowing adults to access legal speech. The Court stated that content-based restrictions on speech must pass “strict scrutiny,” meaning they must be narrowly tailored and use the least restrictive means to achieve their goal. COPA (the law being challenged) did not meet this high bar.
The Court ruled that the government has less restrictive means, such as parental controls, to shield minors from adult content and that mandated age verification violates privacy rights, forcing adults to submit personal information to access legal content. Additionally, such laws place an undue burden on businesses, effectively acting as censorship in violation of the First Amendment.
While diMENsions does not impose age verification, we do require users to certify that they are 18 years or older and provide their state or location of residence. Misrepresentation of age or location will result in account termination.
